1985 report based on British and American crash data, found that driver error, intoxication and other human factors contribute wholly or partially to about 93% of crashes.[6]

An RAC survey of British drivers found that most considered themselves to be "good" drivers, but that most others were not. Nearly all drivers who had had an accident did not believe themselves to be to blame.[7] One survey of drivers reported that they thought the key elements of good driving were:[8]

controlling a car including a good awareness of the car's size and capabilities

reading and reacting to road conditions, weather, road signs and the environment

alertness, reading and anticipating the behaviour of other drivers.

Although proficiency in these skills is taught and tested as part of the driving exam, a 'good' driver can still be at a high risk of accidents because:

"the feeling of being confident in more and more challenging situations is experienced as evidence of driving ability, and that 'proven' ability reinforces the feelings of confidence. Confidence feeds itself and grows unchecked until something happens ? a near-miss or an accident".[8]

Professor Smeed observed that drivers balance risks as they drive, leading road authorities to attempt to reduce the consequences of mishaps through road design.[citation needed] As traffic levels have increased, accompanied by more interventions by planners and road safety teams, accident levels have reduced.[citation needed]

Accompanying changes to road designs have been wide-scale adoptions of rules of the road alongside law enforcement policies that included drink-driving laws, setting of speed limits, and speed enforcement systems such as speed cameras. Some countries' driving tests have been expanded to test a new driver's behaviour during emergencies, and their hazard perception.

There are demographic differences in accident rates. For example, although young people tend to have good reaction times, disproportionately more young male drivers feature in accidents,[9] with researchers observing that many exhibit behaviours and attitudes to risk that can place them in more hazardous situations than other road users.[8] This gets reflected by actuaries when they set insurance rates for different age groups, partly based on their age, sex, and choice of vehicle. Older drivers with slower reactions would be expected to be involved in more accidents, but this has not been the case as they tend to drive less and, apparently, more cautiously.[10]

Attempts to impose traffic policies can be complicated by local circumstances and driver behaviour. In 1969 Leeming warned that there is a balance to be struck when "improving" the safety of a road:[5]

It can safely be said that many places which look dangerous do not have accidents, or very few. Conversely, a location that does not look dangerous may have a high crash frequency. The reason for this is simple. If drivers perceive a location as hazardous, they take more care and there are no accidents. Accidents happen when hazardous road or traffic conditions are not obvious at a glance, or where the conditions are too complicated for the limited human machine to perceive and react in the time and distance available.

This phenomena has been observed in risk compensation research, where the predicted reductions in accident rates have not occurred after legislative or technical changes. One study observed that the introduction of improved brakes resulted in more aggressive driving,[11] and another argued that compulsory seat belt laws have not been accompanied by a clearly-attributed fall in overall fatalities.[12]

In the 1990s Hans Monderman's studies of driver behaviour led him to the realisation that signs and regulations had an adverse effect on a driver's ability to interact safely with other road users. Monderman developed shared space principles, rooted in the principles of the woonerven of the 1970s. He found that the removal of highway clutter, while allowing drivers and other road users to mingle with equal priority, could help drivers recognise environmental clues. They relied on their cognitive skills alone, reducing traffic speeds radically and resulting in lower levels of road casualties and lower levels of congestion.[13]

行政法上の責任 - 運転免許に関する行政処分

交通事故の定義とは関係なく、車両等の運転者が過失により人を死傷させた場合は、行為の様態に応じて「危険運転致死傷罪」、「自動車運転過失致死傷罪」または「重過失致死傷罪」等に問われ、物を損壊した場合は、「過失建造物損壊」（その他の道路交通法違反）に問われる可能性がある。なお、故意に人の死傷や物の損壊を起こした場合には殺人（未遂）罪を始めとする凶悪犯・粗暴犯とされる。

なお、人身事故および建造物損壊事故を除く、物損事故の場合は、加害者に刑事罰が課されることはない。

また、交通事故を含む事故において故意または過失により他人の権利（生命、身体または財産）を侵害した場合、それによって発生した損害を賠償する責任を負う（民法の不法行為原則）。人身事故、建造物損壊事故および物損事故の全てが該当する。

自動車または原動機付自転車の運行により人の生命または身体を侵害した場合には、加害者側で被害者の過失を立証しなければこれによって生じた損害（他人の生命、身体に対するものに限る）についてその責めを負い、重大な賠償責任を負担する事が殆どである。

さらに、行政処分として事故や責任の重さに応じて運転免許の取り消し、停止などがある。

人身事故における行政処分では、加害者の過失が少しでも認められた場合、安全運転義務違反（2点）および人身に係る交通事故の付加点数（最低2点）で最低でも合計4点の付加点数が付くこととなる。

なお、人身事故および建造物損壊事故を除く、物損事故の場合は、運転者が行政処分を受けることはない。
